Terms of Use Policy

This website, www.janehousley.com, is owned and operated by Jane Housley. The ‘I' referred to in this Terms of Use Policy is Jane Housley.

By accessing or using this website and service, you approve that you have read, understood, and agree to be bound by these Terms.

​

Payments + Refunds: I begin your commissioned painting and order the (optional) frame upon payment of the 50% deposit. The deposit is therefore non-refundable, except at my discretion.

​

The balance of payment is only due upon your approval of a photograph of the finished artwork. Once payment is received, I arrange for delivery of the painting.

​

I carry out, free of charge, any number of revisions to the finished artwork providing they are in line with the agreed design set out in the initial deposit invoice.

​

If, through the delivery process, there is any damage to your painting or a painting you purchased as a gift, the recipient must notify me upon receipt of the delivery via email at jh@janehousley.com and provide photographic evidence of the damage. Notification should be made as soon as possible after delivery and no longer than a day later.

 

Upon the return of the artwork to me, I will do one of the following at no additional cost to the customer:

  • Repair the painting if either paintwork or board are slightly damaged;

  • Reproduce the commissioned piece to the same design, if damaged beyond repair;

  • Replace a damaged frame with a frame of the same design and colour.

 

These terms apply only if the artwork is returned to me.

 It is the customer’s responsibility to organise and pay for the return of the artwork to me. It is my responsibility to organise and pay for delivery of the repaired or replaced piece.

​

If I am unable to repair or reproduce the artwork within 4 weeks, the customer shall be entitled to a full refund, including the cost of the return delivery of the artwork.

​

Delivery time-frame: I make an extensive effort to meet the 3 week (unframed) or 4 week (framed) deadlines set out on the website, or to meet a more urgent deadline that we have mutually agreed, but this does not constitute a guarantee.  At the time of writing this, I have not failed to meet a deadline.

​

Framing: If you choose to purchase a frame online and do the framing yourself, you should wait for delivery of the completed painting before you place your frame order. This is because board sizes can vary slightly from those stipulated.

 

Care of your Painting: I use high quality materials to ensure your artwork is archival. However, as with any painting, it must not be placed in an area of high humidity such as a bathroom or close to sink/ hob / kettle in a kitchen. Although acrylic paint is less prone to fading than oil paint, and I use a protective UV varnish, it is advisable not to place an acrylic painting in a permanent position of direct sunlight.

Ownership of Content/ Copyright: I, Jane Housley, am the artist and sole copyright holder of all artwork and site content (images of artwork, text, video material and logo) displayed on this site.

 

Solely for your own personal and non-commercial use, you may print an image of your commissioned painting or share  electronically a photograph that you or I have taken of the finished piece. The painting must not be copied, reproduced, modified or published in any format for any other purpose without my express written permission.

 

I will never reproduce your portrait painting for commercial purposes or allow the image to be used by a third party, to my knowledge, without your express permission.

I reserve the right to display an image of your commissioned painting on my website and to use it for promotional purposes, such as on social or printed media. You may withdraw your consent and it is advisable to do so before approving the finished artwork. This will be in good time to prevent me from displaying your commissioned artwork on the website.

​

Third Party Copyright: If a source photograph has been taken by a third party such as a professional photographer, you must obtain permission from the copyright holder of the source material and provide proof of this prior to paying the deposit.
